To grant an order of Interim Stay of the impugned order dated 14.09.2017 passed by the 3rd respondent in Ref.No:PRO/20172018/08 pending disposal of the main Writ Petition. Prayer in WP(MD). 17636/ 2017 :

Writ Petition is filed under Article 226 of the Constitution of India, to call for the records relating to the impugned order dated 14.09.2017 passed by the 3rd respondent in Ref.No:PRO/2017-2018/08 and quash the same as illegal and consequently direct the 3rd respondent to give promotion to the petitioner as a Headmaster in the 4th respondent School. ORDER

Alleging non-compliance of the Order, dated 19.09.2017, made in W.P.(MD) No.14193 of 2017, the present contempt petition has been filed.

2. The petitioner has filed the Contempt petition by alleging that the respondent/contemnor has disobeyed the interim order passed by this Court in W.P(MD) No.17636 of 2017 dated 19.09.2017. In support of his contention, he relied upon a communication, dated 13.06.2019 in e.f. vz;.4734/M4/2018.

3. The learned Special Government Pleader on instructions would submit that in pursuance of the interim order, the District Education Officer has not approved the fifth respondent as Head-Master of the school. Therefore, there is no disobedience against the contemnor. The copy of the above said communication, dated 13.06.2019 is placed on record.

3. Recording the aforesaid submission, this Contempt Petition is closed.
