Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus directing the respondent Nos. 1 to 3 to appoint Special Public Prosecutor in S.C.No.3 of 2007 in Crime No.461 of 2007 on the file of the learned Special Additional District and Sessions Judge For Communal Clash Cases, Madurai.
Order: This Petition coming on this day, upon perusing the petition, affidavit and the earlier order of this Court dated 03/12/2020 and upon perusing the letter in D.No.207/2021 dated 02.09.2021 received from District and Sessions Judge, Communal Clash Cases Court, Madurai, requesting extention of six months time to complete the trial in S.C.No.3 of 2009, this court made the following order: This Court vide order dated 03.12.2020, directed the Special Additional District and Sessions Judge for Communal Clash Cases, Madurai, to complete the trial in S.C.Nos.2 of 2010 and 3 of 2009, within a period of the three weeks from the date of receipt of a copy of that order.
2. Subsequently, the learned District and Sessions Judge, Communal Clash Cases Court, Madurai, sent a letter to the Registry, stating that Mr.K.S.Prabhakaran, Special Public Prosecutor, who was https://hcservices.ecourts.gov.in/hcservices/ 1/2
WP(MD). No.15613 of 2017 appointed to conduct the trial in S.C.No.3 of 2009, has resigned his post and therefore, six months time may be granted to complete the trial.
3. Now, it is stated that Mr.P.Kameswaran, is appointed as Special Public Prosecutor, to conduct the trial in S.C.No.3 of 2009. Therefore, six months time is granted to complete the trial in the said case.
