PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to forthwith and permanently cease the payment of family pension under PPO No. C182543/EDP to the 5th respondent and consequently direct the respondents 1 to 4 to disburse the arrears of family pension rightfully due to the estate of the late Smt. R.Pushpam for the period from 20.11.2019 to 14.02.2021 along with compensatory interest at the rate of 8 percent per annum, to the petitioner and her siblings as the legal heirs.

This writ petition is filed seeking a mandamus directing the respondents 1 to 4 to forthwith and permanently cease the payment of family pension under PPO No. C182543/EDP to the 5th respondent and consequently direct the respondents 1 to 4 to disburse the arrears of family pension rightfully due to the estate of the late Smt. R.Pushpam for the period from 20.11.2019 to 14.02.2021 along with compensatory interest at the rate of 8 percent per annum, to the petitioner and her siblings as the legal heirs.

Considering the fact that the petitioner had made a representation to the respondents including the first respondent seeking for the terminal benefits of the petitioner's father in favour of the petitioner's mother, there shall be an order of direction to the first respondent to consider the representation of the petitioner dated 02.09.2025 in accordance with law and also in conjunction with the judgment and decree made in O.S.No.24 of 2020 dated 31.07.2025 after affording an opportunity to the fifth respondent herein and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.

3. With the above direction, this Writ Petition is disposed of. Consequently, connected miscellaneous petition stands closed. In view of the fact that this Court had directed the first respondent to also hear the fifth respondent herein, notice to the fifth respondent in the present writ petition is dispensed with. No costs.
