Contempt Petition filed under Section 11 of Contempt of Courts Act, to punish the respondents herein for their deliberate and willful disobedience of the order of this Court dated 27.02.2017 passed in W.P.(MD)No.2910 of 2017.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned proceedings issued by the 4th respondent District Educational officer in A.Thi.Mu.No. 4776/A2/2005 dated 23.08.2005, quash the same and further direct the 4th respondent District Educational officer to approve forthwith the appointment of the petitioner as Record Clerk w.e.f.30.05.2005 to 06.02.2006 in the 5th respondent school namely, T.C.K. Higher Secondary School, Padanthalumoodu, Kanyakumari District with all attendant benefits, including arrears of salary and allowances and pass such further or other suitable order/ orders as this Hon'ble Court may deem fir and proper.

ORDER

The petitioner filed W.P.(MD)No.2910 of 2017 before this Court for non-approving his appointment as Record Clerk in the 5th respondent School with effect from 30.05.2005 to 06.02.2006. This Court, vide order 27.02.2017, allowed the writ petition and directed the 4th respondent to accord approval to the appointment of the petitioner as Record Clerk in the 5th respondent School with effect from 30.05.2005 to 06.02.2006 with all monetary and other service benefits.

2. The learned Special Government Pleader appearing for the respondent submitted that there was a ban from the year 2004 to 2006 and therefore, approval was not given. It is stated that appeals in W.A.(MD)Nos.328 and 329 of 2020 have been preferred.

3. In view of the above, the contempt petition is closed. Consequently, Sub A (MD) No.49 of 2018 is also closed.
