ORDER
This criminal original petition has been filed seeking to set aside the return docket order made in Un-Numbered Crl MP No. of 2022, dated 06.12.2022, on the file of the learned Judicial Magistrate, Sathankulam and consequently direct the learned Judicial Magistrate, Sathankulam to take the petition on file and dispose the same.
2.The learned Counsel appearing for the petitioner would submit that the petitioner has filed an application under Section 457 Cr.P.C., seeking direction to the police authorities to produce the vehicle i.e., TVS JUPITER ZX bearing Registration No.TN 92 H 4291 before the concerned Court, but the learned Judicial Magistrate, Sathankulam, has returned the petition by raising a query as to whether confiscation proceedings are pending. 3.The learned Additional Public Prosecutor appearing for the respondent would submit that originally, a case was registered by the respondent police and subsequently, the same was transferred to PEW Wing, 2/5
Thoothukudi. He would further submit that the property has not been produced before the concerned Court and that the respondent police is ready to produce the same before the concerned Court. 4.Recording the submission made by the learned Additional Public Prosecutor, the Inspector of Police, PEW Wing, Thoothukudi, is directed to remand the vehicle bearing Registration No. TN 92 H 4291 before the jurisdictional Court, within a period of one week, from the date of receipt of a copy of this order.
