Respondent/respondent Prayer: Contempt petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents for his wilful, deliberate disobedience to the order of this Court dated 01.06.2018 passed in W.P.(MD).No.11550 of 2018.

Prayer in WP(MD). 11550/ 2018 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Mandamus to direct the 1st and 2nd respondents to take appropriate action to evict the 3rd respondent from the survey No.65/7, Mokur Village, Pattukkottai Taluk, Thanjavur District based on the representation dated 04.05.2018.

ORDER

This contempt petition is filed alleging wilful disobedience of the order which is in the nature of interim direction in the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont P.(MD).No.1184 of 2018 following lines.

"Considering the above facts and circumstances of the case, first and second respondents are directed not to permit the third respondent to enter into the Survey No.65/7, Mokur Village, Pattukkottai Taluk, Thanjavur District, till 08.06.2018.

Post the matter on 08.06.2018."

2.The learned Additional Government Pleader submitted that the petitioner in the writ petition has withdrawn the writ petition and based on the endorsement, the writ petition is dismissed as withdrawn. However, the petitioner has filed the present contempt petition for wilful disobedience of the order, dated 01.06.2018. 3.The interim order itself is valid till 08.06.2018. No records were produced before this Court to show that the respondents has violated the order of this Court.

4.The direction of this Court earlier is in the nature of mandamus directing the respondents 1 and 2 not to permit the third respondent to enter into the S.No.65/7 in Mokur Village. It is not the case of petition in the affidavit file in support of this petition that any one of the respondents have permitted the third respondent to enter the land in violation of the court order. 5.Hence, this contempt petition is dismissed.
