PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondent No.3 herein to not to interfere in the money transaction and consequently not to harass the petitioners under the guise of the enquiry in pursuance of the complaint lodged by the respondent No.6. For Petitioners :Mr.C.Senthil Murugan For R1 to R3 :Mr.M.Sakthi Kumar Government Advocate (Crl. Side) O RDER This Criminal Original Petition is filed to direct the respondent No.3 herein not to interfere in the money transaction and consequently not to harass the petitioners under the guise of the enquiry, in pursuance of the complaint lodged by the respondent No.6.

2. The learned Government Advocate (Crl.Side) would submit that only on the basis of the order passed by this Court in W.P(MD) No.24969 of 2023, enquiry was undertaken in CSR No.440 of 2023. The sixth respondent namely Pandi Alagappan gave a complaint against these petitioners and others, based upon which, summon was issued to the petitioners. 2/4

Now the grievance of the petitioners is that on the earlier complaint given by them against the sixth respondent, a case in Crime No.173 of 2023 has been registered for the offences punishable under Sections 294(b), 506(i) IPC and 3 of TN Prohibition of Charging Exorbitant Interest Act, 2003 and it is stated to be pending. Now, a counter complaint has been registered by the sixth respondent against the petitioners.

4. Let the petitioners and the private respondents appear before the third respondent Police and co-operate with him to complete the process of enquiry. Let the above said enquiry be completed within fifteen days from the date of appearance of the parties. If any trouble arises during the course of enquiry, the petitioner can workout his remedy through appropriate proceedings.

5. With the above said directions and liberty, this Criminal Original Petition is disposed of.
