J U D G M E N T

[Judgment of the Court was made by DR.G.JAYACHANDRAN, J.] This writ appeal is filed by the respondents 1 & 2 in the writ petition being aggrieved by the interim direction issued by the learned Single Judge vide order dated 24.04.2025 passed in W.M.P.(MD) No.5461 of 2025 in W.P.(MD) No.7236 of 2025.

2. It is contended by the appellants that the interim direction granted by the learned Single Judge tantamounts to allowing the main writ petition filed by the first respondent / writ petitioner without affording an opportunity to them.

3. On perusing the impugned order passed by the learned Single Judge, we find that since no counter was filed by the appellants herein in the writ petition, the impugned interim order came to be passed. The interim direction issued by the learned Single Judge is to disburse the monthly salary to the first respondent / writ petitioner from June 2023 onwards pending further orders. The main writ petition is filed by the first respondent seeking a writ of mandamus directing the appellants herein to sanction and disburse forthwith the monthly salary payable to her from June 2023 onwards with appropriate interest. Since the very appointment of the first respondent under promotion to the post of Assistant Professor (Level 11) vide proceedings dated 06.04.

2023 is the subject matter of consideration in the said writ petition, we are of the view that the interim relief granted by the learned Single Judge tantamounts to allowing the main writ petition. It is brought to the notice of this Court that now, the appellants herein have filed their counter affidavit in the said writ petition. In such circumstances, we are inclined to set aside the impugned order passed by the learned Single Judge and to direct the said writ petition to be disposed of as expeditiously as possible.

4. Accordingly, this writ appeal is allowed and the impugned order dated 24.04.2025, passed in W.M.P.(MD) No.5461 of 2025 in W.P.(MD) No. 7236 of 2025, is hereby set aside. Since pleadings are complete in the writ petition, the learned Single Judge, who is dealing with the said writ petition, shall take up the same on priority basis and dispose of the same as expeditiously as possible. No costs. Consequently, connected miscellaneous petition is closed.
