PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to transer the investigation in crime No.97 of 2022 from the file of the third respondent to the file of the fourth respondent and consequently direct the fourth respondent to conduct proper investigation in an expeditious manner within the stipulated period as prescribed by this Court.

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking direction to transer the investigation in crime No.97 of 2022 from the file of the third respondent to the file of the fourth respondent and consequently direct the fourth respondent to conduct proper investigation in an expeditious manner within the stipulated period as prescribed by this Court.

2.The learned Additional Public Prosecutor would submit that the case in Crime No.98 of 2022 has been closed as mistake of fact.

3. Since it is the case and counter case, both the matter must be enquired simultaneously by the third respondent, on that ground, the matter cannot be transferred to other officer.

4. In view of the above said statement given by the learned Additional Public Prosecutor, the investigation shall be completed in 2/4

both the matters as per the procedure and law set out in Police standing order and file the final report within three months from the date of receipt of copy of this order.
