No.107 of 2023:- Criminal Miscellaneous Petition filed Under Section 482 of Cr.P.C., to extend the time for a further period of six months to complete the investigation and to file a final report as per the directions given by this Madurai Bench of Madras High Court,Madurai by its order dated 11.04.2022 made in Crl.O.P.(MD)No.2388 of 2022. Prayer in Crl.O.P.(MD)No.2388 of 2022:- Criminal Original Petition filed under Section 482 Cr.P.C. Praying this Court to transfer the investigation in Crime No.08 of 2022 pending on the file of 2nd respondent to the file of the 3rd respondent with a direction to investigate into the matter and file charge sheet in accordance with law.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. E. Antony Sahaya Prabahar, Additional Public Prosecutor for the Petitioners and of Mr. J. Sulthan Basha, Advocate for the respondent, this Court made the following order:
The Investigating Officer in Crime No.3 of 2022 has filed the above application seeking extension of time to complete the investigation and file a final report.

2. It is seen from the records that this Court in Crl.O.P.(MD) No.2388 of 2022 vide order dated 11.04.2022 has directed the third respondent therein/the Deputy Superintendent of Police, CBCID, Tirunelveli District to depute the investigation officer in the cadre of Inspector of Police and complete the investigation within a period of twelve weeks from the date of receipt of the entire case diary in Crime No.8 of 2022.
3. The learned Additional Public Prosecutor appearing for the petitioners would submit that the entire case diary in Crime No.8 of 2022 was received in September 2022 and that investigation is pending. He would further submit that the investigation officer is taking steps to examine Justice Mrs.Vimala, who was present in the scene of occurrence and seeks six months time to complete the investigation and file a final report.
4. Considering the above facts and circumstances of the case, four months further time is granted to complete the investigation and file a final report from the date of receipt of a copy of this order.
5. Accordingly, this petition is ordered.
