O R D E R

This Writ Petition is filed seeking a Mandamus as against the respondents 1 to 4 herein to initiate appropriate action against the respondents 5 to 22 based on the representation sent by the petitioner dated 18.09.2023.

2. The petitioner made a representation on 18.09.2023, stating certain misdeeds on the part of the private teachers working in a private school and seeking to take disciplinary action against the 3/6

respondents 5 to 22 under the Tamil Nadu Government Servants Conduct Rules, 1973. Since the same was not considered till date, the petitioner has approached this Court.

The learned Government Advocate appearing for the respondents 1 to 4 would submit that if there is any complaint against the Government servants, the concerned Department can take disciplinary action and no private people can insist to take disciplinary action against the Government Servants. However, if it is any substance in the said complaint, action will be taken in accordance with law.

Such being the case, as rightly contended by the learned Government Advocate appearing for the respondents 1 to 4, if there is any complaint against the Government servants, the concerned Department can take disciplinary action against them. In the present case, the petitioner brought certain alleged misdeeds on the part of the private teachers to the knowledge of the respondents and therefore, it is for the respondents to verify the said aspect and take action against them. It is made clear that the petitioner's representation only be construed as information about the conduct of the Teachers in the private school and if 4/6

at all there is any substance in the said complaint, it is up to them to initiate appropriate action as per the Tamil Nadu Government Servants Conduct Rules, 1973. Therefore, the petitioner cannot seek a Mandamus to consider his representation.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
