JUDGMENT

(Judgment of the Court was made by DR.ANITA SUMANTH, J.) This writ appeal is filed challenging an order dated 01.08.2025. The writ petitioner is R1 in the appeal and is married to the appellant. She had sought a mandamus directing the Chief Educational Officer, District Educational Officer and Block Education Officer, Sivakasi, Virudhunagar District to include her name in the service records maintained by them in relation to the appellant, as his lawfully wedded wife.

2.The learned Judge has recorded the position that the divorce petition filed by the appellant was dismissed, the restitution of conjugal rights petition filed by R1 was allowed and admittedly Civil Miscellaneous Appeal filed by the appellant as against the dismissal of the divorce petition has also been dismissed on 14.10.2022. 3.In such circumstances, we find absolutely nothing untoward with the conclusion of the writ Court to consider the request of the 2/5

petitioner. In fact, we are of the view that there is nothing that stops the authorities to conclude the matter in favour of R1. 4.Mr.V.Sasi Kumar, learned counsel appearing for the appellant would submit that an appeal has been moved on 19.08.2025 along with a condone delay petition challenging order dated 14.10.2022. In our view, that would have no impact on the order passed by the writ Court which we have confirmed now.

5.Needless to say, if at all order dated 14.10.2022 is reversed in a manner known to law at any point of time, consequence would be given to R1. In light of the order passed, we see no necessity to issue notice to R1.
