For R1 to R3 : Mr.M.Marichelliah Prabhu Additional Government Pleader C O M M O N O R D E R These writ petitions have been filed for a direction to the first respondent to settle the retirement benefits along with all pending service benefits as requested in the petitioner's representation, dated 26.08.2017, to the petitioners.
2. The case of the petitioners is that they worked as Elementary Teachers in the fourth respondent School from 1984 and 1985 onwards. They had obtained Teachers Certificate Higher from the Karnataka Secondary Education Examination Board, Banglaore, in the year 1980. After rendering so many years of service, there was a dispute with regard to the certificate obtained by the petitioners and they were suspended from service. Thereafter, the petitioners and 15 others filed a writ petition before this Court and the Division Bench of this Court, by order dated 14.07.1997, quashed the order of suspension. Thereafter, the petitioners superannuated in the year 2016 and 2014 respectively. Even after the retirement, the terminal benefits were not settled to the petitioners. Hence, the petitioners have made a representation to the respondents on 26.08.2017. However, till date no order was passed. Therefore, the petitioners have filed the present writ petitions with the aforesaid prayer.
3. The learned counsel appearing for the petitioners would submit that this Court may issue a direction to the respondents to dispose of the representation of the petitioners, dated 26.08.2017, on merits and in accordance with law, within a specified period.
4. The learned Additional Government Pleader appearing for the respondents 1 to 3 has no serious objection for such an order being passed by this Court.
5. Considering the limited request made by the learned counsel for the petitioners, this Court, without going into the merits of the matters, directs the respondents 1 to 3 to consider the petitioners' representation, dated 26.08.2017 and pass orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above direction, these Writ Petitions are disposed of. No costs.
