PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents not to establish TASMAC Wine Shop and Bar in the property of S.Jayavel Naicker in Survey No.2/2A at Puthur, Vilathikulam Taluk, Thoothukudi District, based on the petitioner's representation dated 27.06.2017.

[Order of the Court was made by D.KRISHNAKUMAR, J.] The prayer in this writ petition is for issuance of a writ of mandamus directing the respondents not to establish TASMAC Wine Shop and Bar in the property of one Jayavel Naicker, in Survey No.2/2A of Puthur Village, Vilathikulam Taluk, Thoothukudi District, based on the petitioner's representation dated 27.06.2017.

2. Today, when the matter was taken up for hearing, learned Standing Counsel appearing for the respondent - TASMAC, on instructions, submitted that it has been decided to shift the TASMAC Shop No.10143 from Door No.21/1, Pudur Village, Vilathikulam Taluk, Thoothukudi District to Door Nos.55 & 56, Paralatchi Road, belongs to one Vetrivelan and not to the land in Survey No.2/2A of Puthur Village, Vilathiukulam Taluk, Thoothukudi District, belongs to one Jayavel Naicker. To that effect, he has also produced a copy of the proceedings of the District Collector, dated 27.09.2022, before this Court.

3. In view of the above, no further adjudication is required in this writ petition and the same is therefore closed. No costs. Consequently, connected miscellaneous petition is closed.
