PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to dispose of the petitioner's representation, dated 07.04.2024 and to cancel the joint Patt Nos. 3715 and 5837, dated 23.05.2024 and 02.08.2000 stands in the name of the third 1/5

parties respectively and to issue separate patta in the petitioner's name and the property is situated at Theni District, Periyakulam Taluk, Thamaraikulam Village Bit-II consists in S.Nos.846/2, 846/3 and 846/4 within a stipulated time may be fixed by this Court.

O R D E R

This writ petition has been filed for a direction to the first respondent to dispose of the petitioner's representation, dated 07.04.2024, to cancel the joint patta stands in the name of the third parties and to issue separate patta in the petitioner's name for the property in S.Nos.846/2, 846/3 and 846/4 at Thamaraikulam Village Bit-II, Periyakulam Taluk, Theni District.

2. The petitioner and the respondents 3 to 7, who had no manner of right over the property in S.Nos.846/3 and 846/4, were issued with joint patta in Patta Nos.3715 and 5837. Therefore, the petitioner approached the respondents 1 and 2 to issue separate patta in his name by removing the names of other persons from the patta. The petitioner submitted a representation on 07.04.2024 to the 2/5

first respondent and the first respondent issued memorandum dated 08.05.2024 to the second respondent to scrutinize the documents relating to S.Nos.846/3 and 846/4, conduct enquiry and sent him report. Inspite of the aforesaid memorandum, the second respondent did not conduct any enquiry, the petitioner hence filed the above writ petition for the aforesaid relief.

3. It is seen that the first respondent directed the second respondent to scrutinize the documents relating to S.Nos.846/3 and 846/4, conduct enquiry and sent him a report. The second respondent has not initiated any action on the said memorandum till date and therefore, I am inclined to direct the second respondent to comply with the memorandum of the first respondent, dated 08.05.2024 within a period of 12 weeks from the date of receipt of a copy of this order.

4. Accordingly, the writ petition stands disposed of. No costs. 14.11.2024 NCC:yes/no Index:yes/no Internet:yes/no SN 3/5
