ORDER
Seeking to quash the order passed by the second respondent in his proceedings bearing Na.Ka.No.Ka.Aa/Pi.E/KA/4691/2024, dated 16.07.2024, and consequently, to direct the respondents to make necessary correction in the Birth Certificate of the petitioner's daughter, the petitioner is before this Court.
2. It is the case of the petitioner that she was born a Muslim on 19.09.1987 at Trichy. Her parents named her as 'Jainbeevi' and this name was recorded in both her School Transfer Certificate as well as Community Certificate. Thereafter, she married one L.Rajeshkanna on 18.03.2012 and out of their wedlock, they were blessed with female child, Rakshana, born on 01.03.2013.
3. It the contention of the petitioner that subsequent to her marriage, she converted to Hindu religion and changed her name from Jainbeevi to R.Jain on 19.03.2025 and the same has also been published in the gazette. In the birth
certificate of her daughter, Rakshana, the petitioner's name was erroneously entered as R.Jeyanthi. In order to rectify the same, the petitioner submitted an application to the first respondent on 27.06.2024 requesting correction of her name in the birth certificate of her daughter to R.Jain. The second respondent to whom the petitioner's application was forwarded, had rejected the petitioner's request on the ground that the name sought to be corrected bears no resemblance to the name originally recorded and as such, the correction could not be permitted. Challenging the same, this writ petition has been filed.
4. Heard the learned counsels on either side.
5. Admittedly, the petitioner's birth name was Jainbeevi. It is her contention that subsequent to her marriage, her name was changed as R.Jeyanthi. This name features in her daughter birth certificate, which prompted the petitioner to seek correction of the same. However, the petitioner has not produced any documentary evidence to establish that she was known as R.Jeyanthi at any point in time, apart from the birth certificate. Even in the Gazette notification dated 30.04.2025, the petitioner has not stated as her name was changed from Jeyanthi
to R.Jain, but it is stated that her original name was Jainbeevi, which had been converted into R.Jain. Be that as it may, the name change itself has taken place only in the month of March 2025 and on the date of birth of her daughter, she was on record known as Jainbeevi. Therefore, I do not see any reason to interfere with the impugned order passed by the second respondent. Hence, this Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
