PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari, calling for the entire record pertaining to the Impugned Transfer Order in Adm/P2/539-1 dated 03.12.2022 issued by the 2nd respondent and quash the same. For Petitioner :

O R D E R

This Writ Petition has been filed to call for the entire records pertaining to the Impugned Transfer Order in Adm/P2/539-1 dated 03.12.2022 issued by the 2nd respondent and quash the same.

2. The learned counsel appearing for the petitioner would submit that the petitioner is working as Conductor in the respondents Corporation for a long time. Recently, he was issued with a charge memo and thereafter, the impugned order of transfer has been issued with malafide intention. The petitioner is going to be retired within one year. Hence, challenging the order of transfer, the present writ petition has been filed.

3. Though a larger relief has been sought for by the petitioner in the present writ petition, since the petitioner is going to be retired within one year, this Court, without going to the merits of the case of the petitioner, permits the petitioner to join duty in the transferred place within a period of one week from the date of receipt of a copy of this order. Liberty is granted to the petitioner to make a representation before the respondents for retransfer on the ground that he is going to be retired within one year. If any such representation is made by the petitioner, the respondents are directed to consider the same and pass appropriate orders.

4. Accordingly, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 14.12.2022 Index : Yes / No Speaking Order : Yes / No ssb
