PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent Nos.3 to 5 to remove the encroachment put up in Odai Poramboke in Survey Nos.78 and 93, Pernayakkanpatti Village, Thayilpatti Village Panchayat, Sivakasi Taluk, Virudhunagar District based on the petitioner's representations dated 31.07.2017, 04.09.2017 and 07.09.2017, within a stipulated period as fixed by this Honble Court.

[Order of the Court was made by R.MAHADEVAN, J.] This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondent Nos.3 to 5 to remove the encroachment put up in Odai Poramboke in Survey Nos.78 and 93, Pernayakkanpatti Village, Thayilpatti

Village Panchayat, Sivakasi Taluk, Virudhunagar District, based on the petitioner's representations dated 31.07.2017, 04.09.2017 and 07.09.2017, within a time frame.

2. Today, when the matter was taken up for hearing, the learned Government Pleader appearing for the respondents 1 to 7 has produced a communication of the Revenue Tahsildar, Sivakasi, addressed to him in Na.Ka.M1/3526/2018 dated 21.09.2022, along with the reports of the Revenue Inspector, Salwarpatti as well as the Village Administrative Officer, Thayilpatti Village, Sivakasi Taluk and submitted that the encroachment in the place in question has been removed and as on date, there is no encroachment in the place in question.

3. The aforesaid submission of the learned Government Pleader as well as the proceedings of the Revenue Tahsildar, Sivakasi in Na.Ka.M1/3526/2018 dated 21.09.2022, are not refuted by the learned counsel for the petitioner.
