PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 3rd respondent to issue patta in favour of the petitioners for a Ryotwari natham land in SF Nos. 393/2 (00050 Sq. meters), 393/3 (00120 sq. meters) and 393/4 (00120 sq. meters) situated at Ponananvidhuthi Village, Karambakudi Taluk, Pudukottai District, within the period that may be stipulated by this Hon'ble Court based on the representation, dated 24.10.2024. ORDER

The petitioners have filed this Writ Petition for a mandamus, directing the 3rd respondent to issue patta in favour of the petitioners for a Ryotwari natham land in SF Nos. 393/2 (00050 Sq. meters), 393/3 (00120 sq. meters) and 393/4 (00120 sq. meters) situated at Ponananvidhuthi Village, Karambakudi Taluk, Pudukottai District, within the period that may be

stipulated by this Hon'ble Court based on the representation, dated 24.10.2024.

2. The petitioners made several requests to the respondents 1 to 3 to sub-divide the land in Survey No.393/1 and to issue patta in their favour. The respondents 2 and 3 directed the fourth respondent to inspect the land in the aforesaid survey number and to convert 00270 sq.mts., into Ryotwari Natham land from vandipathai. The fourth respondent, thereafter, in his proceedings, proposed to sub-divide the said land in Survey No.393/1 into three sub-divisions, namely, 393/2 (00050 st.mts.), 393/3 (00120 sq.mts.) and 393/4 (00120 sq.mts.) and to convert the said sub-divisions into Ryotwari Natham land.

3. The petitioners, based on the recommendation and proposal of the fourth respondent, submitted a representation to the respondents on 24.10.2024 to issue patta to them. Since the said representation was not considered, the petitioners filed the Writ Petition for the aforesaid relief.

Learned counsel for the petitioners fairly submits that though a larger relief is claimed in the writ petition, it would suffice if a direction is issued to the second respondent to consider the petitioners' representation, dated 24.10.2024, on merit and in accordance with law within a time frame to be fixed by this Court.

5. Considering the limited prayer of the learned counsel for the petitioners, a direction is issued to the second respondent to pass orders on the representation of the petitioners, dated 24.10.2024, on merit and in accordance with law within a period of six weeks from the date of receipt of copy of this order.

6. Writ Petition is disposed of accordingly. No costs. 18.11.2024 NCC :
