2 W.P.(MD)NO.24591 OF 2025 Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to take immediate and appropriate steps to remove the encroachments made by the private respondents in the Sarkar puramboke land and water canal situated in survey Nos.

7/11, 8/1 and 8/11 including the common pathway and water catchment area, and restore the same for public use and directing the respondents 1 to 4 to initiate appropriate legal and departmental action against respondents 5 to 10 for creating illegal encumbrances and executing void settlement deeds over Government land and forbearing the private respondents 5 to 10 from in any manner alienating transferring, selling or attempting to change the revenue classification / patta in respect of the sarkar poramboke lands and water catchment area in survey Nos.7/11, 8/1 and 8/11 and directing the respondents 1 to 4 to ensure free and unobstructed use of the pathway and water catchment area by the Scheduled Caste residents and the general public of the locality based on the petitioner's representation dated 17.02.2025. Heard the petitioner appeared in person.

2. This Court heard the learned Government Advocate appearing for respondents 1, 3 and 4 and the learned Standing counsel appearing for the second respondent.

3. Issuance of notice to the private respondents is dispensed with.

4. The petitioner alleges that the encroachments in the petition-mentioned water canal have not been removed.

5. The learned Government Advocate on instructions from the Tahsildar admits that survey No.179 and 192 have been classified as water bodies.

6. The fourth respondent is directed to conduct survey with reference to their own records. Notice will be issued to all the 3/5

If the results of the survey that indicates that there are encroachments, the same shall be removed by adhering to due process of law. Full opportunity will be given to all the encroachers, if they have committed any encroachment. The entire exercise will be completed within a period of six months from the date of receipt of a copy of this order. This writ petition stands disposed of. No costs.
