This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the appellant Mr.V.Sakthivel and the counsel for the respondents 1 to 5 Ms.A.Ajitha for Mr.K.Esakkidurai are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement.
AWARD Both the parties and their respective counsels are present and they arrived at an amicable settlement for a sum of Rs.56,08,560/- [Rupees Fifty Six Lakhs Eight Thousand Five Hundred and Sixty only] as full quit.
2. It is submitted that already an amount of Rs.33,78,560/- has been deposited before the Tribunal. The same may be withdrawn by the claimants with accrued interest in Court proportionally. The appellant is directed to deposit the remaining amount of Rs. 22,30,000/- [Rupees Twenty Two Lakhs Thirty Thousand only], within a period of four [4] weeks from today.
3. The first respondent / first claimant is permitted to withdraw a sum of Rs.26,08,560/- and the respondents 4 & 5/ claimants 4 & 5 are permitted to withdraw a sum of Rs. 5,00,000/- each, on filing proper petition before the Tribunal. The respondents 2 & 3/ minor claimants 2 & 3 are entitled for a sum of Rs.10,00,000/- each, which shall be deposited in any one of the Nationalized Banks in an interest bearing deposit. The first respondent, who is the guardian / mother of the minor claimants is entitled to withdraw the interest amount, once in a three months, till the minor claimants attain the age of majority. On attaining the age of majority, the minor claimants are permitted to withdraw the aforesaid amount, on filing proper application before the Tribunal. Counsel for the Respondents This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost.
