Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 2nd respondent in 1/4
Ref. Admin/A2/124/2 dated 13.08.2024 and quash the same as illegal and direct the respondent Nos.1 and 2 to treat the 345 days from 07.09.2022 to 17.08.2023 as duty period and pay its salary along with increments, all leave salaries and consequential promotion to the petitioner within a stipulated time as may be fixed by this Court. ORDER
When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that this writ petition has become infructuous, since the petitioner has joined the duty as Driver. However, he seeks liberty of this Court to make a fresh representation before the authorities for regularization of his absence period due to the treatment taken by the petitioner.
2. In view of the above, this writ petition is dismissed as infructuous. However, liberty is granted to the petitioner to make a fresh representation before the concerned authority for regularization of his 2/4
