BNSS, to direct the learned District Munsif Cum Judicial Magistrate, Thiruvidaimaruthur, to dispose of the above Crl.MP.No.3282 of 2021 on his file as expeditiously as possible and within the time stipulated by this Court.

ORDER

The petitioner seeks a direction to the learned District Munsif Cum Judicial Magistrate, Thiruvidaimaruthur, to dispose of the case in Crl.M.P.No.3282 of 2021 within the time stipulated by this Court. 2.The petitioner is the defacto complainant in a case registered in Crime No.13 of 2019 against the respondents 2 to 9. It is his case that the respondents had produced fake sureties and that the petitioner had 2/6

filed the petition in Crl.M.P.No.2913 of 2019 for taking action against the respondents 2 to 9 under Section 193 IPC. 3.The learned counsel for the petitioner would submit that the petition has been pending since 2021 and hence, the learned Magistrate may be directed to dispose of the petition expeditiously. 4.The learned counsel for the respondents 2 to 4 and 6 to 9 would submit that the complaint itself filed by the petitioner in Crime No.13 of 2019 was found to be false; that further action was dropped by the respondent police; that the impugned complaint is an abuse of process of law and that no such direction can be issued. 5.The learned Additional Public Prosecutor appearing for the respondent police confirms the fact that the original complaint filed by the petitioner in Crime No.13 of 2019 has now been closed as action dropped.

6.It is seen from the B-diary entries filed by the petitioner in the typed set of paper that the petitioner himself was absent on several hearings. Hence, the learned Magistrate cannot be faulted for the delay in the conclusion of the enquiry. If the petitioner co-operates and participates in the proceedings, the learned District Munsif Cum Judicial Magistrate, Thiruvidaimaruthur, may consider the expeditious disposal of the petition in Crl.MP.No.3282 of 2021 on merits and in accordance with law.

7.With the above observation, this Criminal Original Petition is disposed of.
