(MD).No.16600 of 2024 dated 30.09.2024 concerned that the petitioner shall report before the respondent police daily at 10.30 a.m. for a period of three weeks and also to issue a public advertisement in one leading Tamil daily namely, Dinamani and in one leading English namely, Hindu, without prejudice to his rights and contentions.

ORDER

This miscellaneous petition is filed seeking modification of the condition imposed in Crl.O.P.(MD).No.16600 of 2024 dated 30.09.2024. 2.

The only ground on which the modification sought for is that, the accused does not have financial capacity to pay money for the publication, which was originally ordered in the two leading newspapers, which comes to more than Rs.3,00,000/-. Therefore, the learned Counsel appearing on behalf of the petitioner seeks modification of the said condition. 3.

Since it is pleaded only on the ground of financial incapacity, I am of the view that the accused can give advertisement in any other daily, where is financial implication is less and that too only in one Tamil newspaper. The learned Counsel suggest that they will give publication in one issue of "Makkal Kural". The learned Government Advocate submits that so long as they give publication, the same can be recorded by this Court. The learned Counsel for the petitioner also seeks modification with reference to the personal appearance of the accused.

In view of the submission that are made on either side, the condition originally imposed stands modified on the following terms: (i) The condition that was originally imposed to give publication in two leading newspapers is concerned, the same shall stands modified to the effect that the petitioner is permitted give publication in one issue of 'Makkal Kural' alone within a period of one week from the date of receipt of a copy of this order. (ii) As far as the condition imposed for personal appearance of the petitioner before the respondent police for a period of three weeks is concerned, the same stands modified to the effect that the petitioner shall report before the respondent police for a period of 10 days daily at 10.30.a.m. (iii) Further, for compliance of other conditions, the time is extended. Accordingly, the petitioner shall comply with the other conditions within a period of one week from the date of receipt of a copy of this order. (iv) All the other conditions remain unaltered.

Accordingly, this miscellaneous petition stands ordered. 23.09.2025 : yes/no veda
