Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records in RFL/1/Joint Sub-Registrar-I/Book 2/26 dated 07.11.2024 on file of the second respondent and quash the same as arbitrary and illegal and consequently direct the second respondent to register the lease deed in document in P.No.110/2024 dated 08.10.2024 presented by the petitioner.

ORDER

The issue raised in this writ petition is squarely covered by a judgment of this Court in W.P.(MD) No.2758 of 2023, dated 08.02.2023. This has also not been disputed by the learned Special Government Pleader appearing on behalf of the respondents. In view of the same, the impugned order dated 07.11.2024 is side aside. The second respondent shall receive the document Pending No.110/2024 and further, proceed to register the document in Pending No.110/2024, dated 08.10.2024 presented by the petitioner.

2. With the above direction, this Writ Petition is allowed. No costs.
