PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of certiorari calling for the records relating to the impugned order passed by the 2nd Respondent in his proceedings in Na.Ka.A2/6042/2014 dated 02.09.2025 and quash the same.

ORDER

The petitioner assails an inquiry notice dated 02.09.2025. 2.Learned counsel for the petitioner relies on sale deed dated 17.06.2004 and joint patta No.391 to assert his rights in respect of the S.No.282/3. 3.Learned Special Government Pleader accepts notice on behalf of the respondents. On instructions, he submits that the present writ petition is an abuse of the process of law and that the petitioner has intentionally not impleaded Thiruvengadam. He also submits that the petitioner's father had earlier filed a petition and that the petitioner is agitating the matter now because the petitioner's father was unsuccessful in earlier proceedings. 4.On perusal of the impugned inquiry notice, it is clear that such notice was issued pursuant to the order dated 05.08.2025 in W.P(MD)No.3610 of 2025.

The said writ petition was filed by one Mathialagan. After the father was unsuccessful, it appears that the son has filed this writ petition. Even otherwise, since the challenge is to an inquiry notice, I am not inclined to interfere. Therefore, this writ petition is dismissed without any order as to costs while leaving it open to the petitioner to participate in the proceedings. Consequently, connected writ miscellaneous petitions are also closed.

5.At the request of learned counsel for the petitioner, the inquiry scheduled for this afternoon shall be deferred and conducted instead on 15.09.2025 at 3.00 p.m. No costs.
