Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to condone the delay of 1455 days occured in filing application to set aside abatement caused against the death of the 2nd respondent.
Prayer in SA(MD) No.158 of 2013:
To call for the records relating to judgment and decree dated 22.11.2012 in A.S.No.14 of 2009 on the file of Additional District cum Sessions Judge, Theni, reversing the judgment and decree dated 09.01.2008 in O.S.No.383 of 2000 on the file of the Subordinate Judge, Periyakulam, set aside the same, thereby allow the present second appeal.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.C.MAHADEVAN, Advocate for the petitioners, the court made the following order:- This petition has been filed to condone the delay of 1455 days in filing the petition to set aside the abatement caused due to the death of the second respondent.
2. Notice delivered and not claimed. Therefore, deemed service. Print the name of the respondents.
3.Though the reasons stated in the accompanying affidavit filed in support of this petition are not satisfied, in order to give an opportunity to the parties to prosecute the appeal, the delay of 1455 days is condoned on condition that the petitioners shall deposit a sum of Rs.15,000/- (Rupees Fifteen Thousand only) towards costs before the Registry to the credit of CMP(MD)No.12641 of 2022 on or before 17.07.2023 and on deposit of the same, the petition shall stand allowed, failing which, the petition shall stand dismissed automatically without further reference to this Court. 4.List the matter on 31.07.2023 for filing compliance report. sd/- 22/06/2023 / TRUE COPY / /07/2023 Sub-Assistant Registrar (C.S.)
