This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the respondent to file a Final report 1/4

in Crime No.146 of 2015 on the file of respondent registered on 01.09.2015 in accordance with law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned Additional Public Prosecutor would submit that the above said case was closed as mistake of fact on 01.09.2015 itself. RCS notice has been served upon the petitioner.

4. The learned counsel for the petitioner would submit that no notice was received by the petitioner.

5. It appears that no record is available in the CD file whether the RCS notice has been served upon the petitioner or not. Let the fresh notice be served upon the petitioner, so that he can workout his remedy through appropriate proceedings.

6. With the above said liberty and direction, this Criminal Original Petition is disposed of.
