Today, when the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the first respondent Police would submit that during the pendency of this petition, the case was referred as "mistake of fact". He would further submit that nothing survives for further adjudication in this petition.

3. Recording the above said submission, the Criminal Original Petition stands dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
