Respondent Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned refusal check slip in RFL/Chettikulam(Madurai North)/202/2024 dated 05.11.2024 and quash the same and consequently direct the respondent to register and release Gift Deed, dated 23.10.2024 executed by the petitioner in favour of the Madurai Corporation as per the direction of the Deputy Director and Member Secretary, Town and Country Planning Department, dated 28.06.2024 within the time to be fixed by this Court. ORDER

The issue raised in this writ petition is squarely covered by a judgment of this Court in P.Pappu vs. Sub-Registrar, Rasipuram SRO, Rasipuram, Namakkal District reported in 2024 (5) CTC 575. This has also not been disputed by the learned Additional Government Pleader appearing on behalf of the respondent. In view of the same, the impugned Check Slip dated 05.11.2024 is side aside. The petitioner is permitted to re-present the Gift Deed within a period of four weeks from today and upon such re-present, the Sub-Registrar, Chettikulam (Madurai North), Madurai, will register the instrument without insisting on production of originals within a period of 15 days from the date of representation.

2. With the above direction, this Writ Petition is allowed. No costs.
