ORDER

The allegation against the petitioner is that he misappropriated society funds amounting to Rs.68,67,300/-. The society has initiated both criminal proceedings and surcharge proceedings against him. Pursuant to the surcharge order, the petitioner is liable to pay a sum of Rs. 34,33,680/-. There are two accused in the case, including the petitioner. It is submitted that the petitioner owns two properties. The second respondent has already attached the petitioner's property under the surcharge proceedings and has also issued a sale notice. In the above circumstances, the petitioner is entitled to receive the terminal benefits payable by the society. 2/4

2. Accordingly, the society is directed to pay a sum of Rs. 11,16,655/- to the petitioner within a period of eight weeks from the date of receipt of a copy of this order. In the event of non-payment within the stipulated time, the petitioner is at liberty to initiate contempt proceedings.

3. Post the matter on 18.03.2026 before this Bench, after obtaining necessary orders from the Hon'ble Administrative Judge. 23-02-2026 (1/2) msrm To
