Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the entire records relating to the impugned proceedings of the respondent in his proceedings in A.No.186/2-J/2017, dated 21.09.2017 and quash the same in so far as clause 30 of the proceedings alone in respect of the petitioner and consequently direct the respondent to promote the petitioner as Assistant on part with her juniors within a specified time frame that may be fixed by this Court. ORDER

(Order of the Court was made by M.DURAISWAMY,J.) Though the petitioner has filed a writ petition to issue a writ of Certiorarified Mandamus, challenging the order dated 21.09.2017, passed by the respondent and consequently directing the respondnet to promote her as Assistant on par with her juniors, Mr.Senthilmurugan, learned Counsel for the petitioner submitted that the respondent had already initiated disciplinary proceedings against the petitioner. Hence, it would be suffice to direct the respondent to complete the disciplinary proceedings within a time frame.

2. Mr.K.Samidurai, learned Counsel for the respondent submitted https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.18449 of 2017 that the disciplinary proceedings is pending before VI Additional District Judge, Madurai and VI Additional District Judge, Madurai may be directed to complete the disciplinary proceedings within a period of two months.

3. Having regard to the submissions made by the learned Counsel on either side, taking into consideration the limited prayer sought for by the learned Counsel for the petitioner, without expressing any opinion with regard to the merits of the case, we direct VI Additional District Judge, Madurai, to complete the enquiry proceedings against the petitioner, within a period of two months from the date of receipt of a copy of this order.

4. With these observations, the Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petitions are closed.
