Respondents PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondents 1 to 3 to give adequate police protection for harvesting Paddy planted in the petitioner's properties bearing Survey No.9/9 measuring to an extent of 79 2/3 cents, in Survey No.15/1 near extending of 0.36.5 acres and 9/2, 0.14.0 ares 17 cents in Nakudi Village, Avudaiyarkovil Taluk, Pudukkottai District, based on the representation given by the petitioner dated 04.12.2019.

O R D E R

This petition has been filed to direct the respondents 1 to 3 to give adequate police protection for harvesting Paddy planted in the petitioner's properties bearing Survey No.9/9 measuring to an extent of 79 2/3 cents, in Survey No.15/1 near extending of 0.36.5 acres and 9/2, 0.14.0 ares 17 cents in Nakudi Village, Avudaiyarkovil Taluk, Pudukkottai District, based on the representation given by the petitioner dated 04.12.2019. 2.The learned counsel for the petitioner would submit that the petitioner is the owner of the property in S.No.9/9 and S.No.15/1 situated at Nakudi Village, Avudaiyarkovil Taluk, Pudukkottai District. He further submitted that the respondents 5 to 15 have prevented the petitioner from harvesting the Paddy crops in the above survey numbers. Regarding this, the petitioner sent a representation to the fourth respondent police dated 04.12.2019 seeking for police protection. Since no action was taken, the petitioner approached this Court.

3.The learned Additional Public Prosecutor would submit that based on the representation given by the petitioner, enquiry has been initiated in CSR.No.393 of 2019 and the respondent police has also issued summon to the respondents 5 to 15. He further submitted that after due enquiry, if it transpires that police protection is required to be given to the petitioner, it will be given by the fourth respondent police.
