PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, To direct the Special Court for trial of SC/ST Act Cases Pudukkotai to consider the petitioners bail application on the date of their surrender in respect of Cr.No.02/2016 on the file of the CBCID Pudukkottai or to execute a bond with or without sureties under Section 88 of the Cr.P.C., for their appearance in the Court instead of taking the accused in the physical custody.

ORDER

This Criminal Original Petition filed to direct the Special Court for trial of SC/ST Act Cases Pudukkotai to consider the petitioners bail application on the date of their surrender in respect of Cr.No.02/2016 on the file of the CBCID Pudukkottai or to execute a bond with or without sureties under Section 88 of the Cr.P.C., for their appearance in the Court instead of taking the accused in the physical custody. 2/4

2. The petitioners are the accused in Crime No.02 of 2016 on the file of the 2nd respondent police for the offences punishable under Sections 167, 218, 220, 330, 348 and 304(ii) of IPC and 3(1)(x), 3(2)(v) of the SC / ST (Prevention of Atrocities) Act, 1989.

3. Mr.M.Vaikkam Karunanithi, learned Government Advocate (Crl. side), accepts notice for the respondents 1 and 2. He would further submitted that only summon has been issued against the petitioner.

4. In view of the submission made, this petition is dismissed as unnecessary.
