ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 03.07.2025 for the 1/5

offences punishable under Sections 9(f), (l), (m), (I) r/w 10, 5(f), (l), (m), (I) r/w 6 of POCSO Act, 2019 and under Section 351(2) of BNS, 2023, in Crime No.21 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner committed penetrative sexual assault on the victim girl. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 03.07.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the victim girl is aged about 6 2/5

years. In the statement of the victim girl recorded under Section 183 (5) BNSS, it is clearly stated that the petitioner committed penetrative sexual assault on the victim girl. Therefore, he opposed for grant of bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and also considering the gravity of offence and the statement of the victim girl recorded under Section 183 (5) BNSS, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this criminal original petition is dismissed.
