PRAYER : Criminal Original Petition filed under Section 439(1)(B) of the Criminal Procedure Code, to modify the condition No.iii)imposed on the petitioners that the Petitioners shall report and sign before the Respondent Police Station daily at 10.00 AM for a period of one month from the date of their release in the Anticipatory Bail order passed in Cr.M.P.No.6551 of 2023 dated 13.10.2023, on the file of the court of the Principal Sessions Judge, Thoothukudi,Thoothukudi District. 1/4

ORDER

This petition has been filed seeking to modify the condition No.iii) imposed on the petitioners that the Petitioners shall report and sign before the Respondent Police Station daily at 10.00 AM for a period of one month from the date of their release in the Anticipatory Bail order passed in Cr.M.P.No.6551 of 2023 dated 13.10.2023, on the file of the court of the Principal Sessions Judge, Thoothukudi,Thoothukudi District. 2.The learned counsel for the petitioners would submit that the petitioners are coolie agricultural workers. The distance between their residence and the Vilathikulam is more than 150 k.m. Hence, they are unable to comply the above said condition.

3.Therefore, challenging the above said condition, the petitioners are before this Court. Considering the nature of offence only, the above said condition was imposed upon them by the Sessions Court. However, 2/4

the petitioners without approaching the Sessions Court for modification, directly came to this Court. I find no reason to entertain this petition. This petition deserves to be dismissed. The petitioners can approach the concerned Court for modification.
