Heard both sides.
2. The petitioner is a resident of Periya Poolampatti Village. He alleges that in the petition-mentioned survey numbers, there are encroachments. Survey No.304/3 has been classified as channel and survey No.306/9 & 10 has been classified as cart track. The encroachments in both the survey numbers cannot be permitted. It is the Tahsildar, Peraiyur Taluk who is the authority competent to take action.
3. We direct the fourth respondent to take effective action so that the encroachments are cleared. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. The fourth respondent shall put all the encroachers on notice and adhere to due process of law before taking action. This writ petition stands disposed of. No costs.
