PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the Judicial Magistrate, Uthapamalayam, to recall the warrant dated 26.10.2023 in Crl.M.P.No. 5384/2023 in M.C No.17/2022.

ORDER

This criminal original petition has been filed seeking direction to the learned Judicial Magistrate, Uthapamalayam, to recall the warrant dated 26.10.2023 in Crl.M.P.No.5384 of 2023 in M.C.No.17 of 2022. 2.The learned counsel for the petitioner would submit that the second respondent filed M.C.No.17 of 2022 before the trial Court, wherein, Rs.10,000/- was ordered to be paid by the petitioner to the second respondent. Since he failed, the second respondent filed Cr.M.P.No.5384 of 2023 seeking issuance of summon to the petitioner herein with direction to deposit a sum of Rs.2,50,000/-. In the above said petition, the trial Court issued warrant against the petitioner herein. Hence, the present petition.

3.The learned counsel for the petitioner submitted that now the petitioner is ready to appear before the concerned Court and deposit the amount that was ordered by the trial Court. If it so, let the petitioner appear before the concerned Court and get the warrant recalled by setting out the facts and circumstances of the case. There is no question of 2/4

recalling the warrant by this Court.

4.With the above said directions, this criminal original petition stands disposed of.
