PRAYER :- For Bail in Crime no.119 of 2023 on the file of the Respondent Police. 1/3

ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 06.09.2023 for the alleged offences punishable under Sections 302 and 201 of IPC in Crime No.119 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that all the accused persons joined together and committed the murder of the deceased. After committing the offence they A1 to A3 have tied the hands and legs of the deceased using rope and kept the dead body in a sack along with big stone and thrown the same into the well AalavandanVillage. Hence the case.

3.The learned counsel appearing for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is not present in the scene of occurrence and he is in custody from 06.09.2023,hence he seeks bail. 4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that all the accused persons brutally murdered the deceased and after committing murder they tied the hands and legs of the deceased using rope and kept the dead body in a sack along with big stone and thrown the same into the well Aalavandan village hence he objected to grant bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the 2/3

gravity of offence committed by the petitioner , this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
