ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under section Girl Missing @ 366, 346 1/3

IPC and 5(1) r/w. 6, 17 of POCSO Act, 2012 in Crime No.385 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein and other accused have forcibly taken the victim and kept her in her house. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is only Taxi Driver and he is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner herein and other accused have forcibly taken the victim and kept her in petitioner's house and the victim is A1's wife's own sister and the petitioner herein is also Taxi Driver and hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
