Mr.Rms.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.23/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner / accused apprehending arrest at the hands of the respondent police for the offences punishable under sections 153, 504, 505(2) IPC and Section 67 1/3
of Information Technology (Amendment) Act, 2008 in Crime No.23 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that in a cartoon picture, a half naked male person wearing a spectacle and yellow colour towel holding a flag of the defacto complainant's political party has circulated in the social Media with the breach peace between the political parties. Further, on 29.07.2023, the photos of the comedy actor vAdivelu, has ben depicted on the face of Chief Minister of Tamil Nadu. Hence, the complaint.
3. The leaned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, he seeks anticipatory bail.
4. The learned Additional Public Prosecutor would submit that the petitioner has depicted the picture of Ex Chief Minister Mr.M.Karunanithi and the Chief Minister of Tamil nadu in the cartoon picture and circulated the same in the social media. Hence, he strongly, opposed to grant anticipatory bail to the petitioner.
5. Considering the serious nature of offence committed by the petitioner and also submission made by the learned Additional Public Prosecutor appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
