PRAYER :- For Bail in Crime No.36 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 10.05.2021 for the offence under Sections 8(c) r/w 20(b) (ii)(C) of NDPS Act in Crime No.36 of 2021, seeks bail. 2.Today, when the matter is taken up for hearing, the learned counsel for the petitioner would submit that the contraband involved in this case is 50 kgs of Ganja, which is a commercial quantity. He would further submit that though the petitioner has got valid grounds for bail, he is not insisting for bail and he would only seek for a direction to the trial Court for speedy disposal of the case.

3.In reply, the learned Additional Public Prosecutor would submit that the petitioner is arrayed as A2 and already, A7 has approached this Court in Crl.O.P.(MD)No.17713 of 2022 and this Court while dismissing the application on 19.10.2022 had already directed https://www.mhc.tn.gov.in/judis 1/2

No.22142 of 2022 the trial Court to complete the trial within a period of three months from the date of receipt of a copy of that order. 4.Taking into consideration the facts and the submissions made by both the counsels and also the earlier order passed by this Court, this Court is not inclined to grant bail to the petitioner. 5.Accordingly, the Criminal Original Petition is dismissed with a direction to the learned I Additional Special Court for NDPS Act Cases, Madurai, strictly to comply with the directions of this Court, in Crl.O.P.(MD)No.17713 of 2022, dated 09.10.2022 and to complete the trial within a period of three months from the date of receipt of a copy of the order dated 09.10.2022. sd/- 22/12/2022 / TRUE COPY / /01/2023 Sub-Assistant Registrar (C.S.)
