Prayer in Crl.OP(MD)No.20894 of 2022:- Petition filed under Section 439(1)(b) of Cr.P.C., to modify the condition No.ii imposed upon the petitioners by the Principal Sessions Court, Theni, in Crl.M.P.No.4296 of 2022, dated 10.11.2022.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.Lenin Kumar, Advocate for the Petitioner and of Mr.T.Senthil Kumar, Additional Public Prosecutor, for the Respondent, this Court made the following order:- This Petition has been filed to relax the condition imposed in Crl.O.P(MD).No.20894 of 2022, dated 25.11.2022.
2. The learned counsel for the petitioners would submit that the petitioners have been complying with the conditions regularly and hence, he seeks for relaxation of the condition.
3. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners have been complying with the conditions.
4. Considering the said submissions and nature of offence, the condition imposed by this Court in Crl.O.P(MD).No.20894 of 2022, https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD). No.15844 of 2022 is modified to the effect that the petitioners 1 and 3 shall report before the respondent police once in a month i.e., on the first working day of every month at 10.30 a.m., until further orders and the petitioners 2 and 4 shall report before the respondent police as and when required for interrogation, on receipt of summons.
5. With the above direction, this Criminal Miscellaneous Petition is ordered.
