PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order vide G.O.(Rt).No.421, Cooperation, Food and Consumer Protection (CE1) Department dated 11.11.2024 passed by the first respondent and consequential proceeding vide Rc.No.2786/2024/P.A2 dated 12.11.2024 passed by the 2nd respondent and quash the same and consequently directing the respondents to permit the petitioner to continue as Administrator of Thoothukudi District Central Cooperative Bank Limited, Thoothukudi. The instant writ petition has been filed by a Joint Registrar/Managing Director of Thoothukudi District Central Cooperative Bank, challenging the order dated 11.11.2024, wherein the third respondent has been transferred to his place and another order dated 12.11.2024, wherein the petitioner has been placed under compulsory wait until further orders. 2/6

On instruction, the learned Counsel appearing for the writ petitioner submits that he is not pressing for quashing the order of transfer of the third respondent and the order of compulsory wait dated 12.11.2024 and he is awaiting for his posting order to be issued by the first respondent to the 2nd respondent herein.

However, it is the grievance of the writ petitioner that on earlier two occasions, when he was placed under compulsory wait for a period of six months in two spells i.e., 15.07.2021 to 24.12.2021 & 30.12.2022 to 16.08.2023, he was not paid salary for the said period by the respondents. Hence, he seeks a direction to the authorities for disbursement of salary for the above said period.

In view of the above said facts, the second respondent herein is directed to disburse the salary for the period during which the petitioner was placed under compulsory wait in two spells as stated above. The said exercise shall be completed within a period of four(4) weeks from the date of receipt of copy of this order.

5. With the above said observations, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 21.11.2024 NCC : Yes/No Index : Yes / No Internet : Yes / No gvn 4/6
