PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to pay the compensation amount declared by the Government of Tamil Nadu to all the Ayacutdars of Edayathu Eri under the Crop Failure Scheme for the Rabi period of 2016. (Order of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.
2. The writ petitioner is a resident of Edayathur village in Pudukkottai District. He claims to be an Ayacutdar of Edayathur Kanmoi. He claims to have suffered crop loss during the year 2016. His grievance is that he has not been paid the compensation amount to indemnify the crop loss. Hence, this writ of mandamus has been filed. 2/5
3. We permit the petitioner to submit a fresh application to the second respondent. The second respondent will convene the grievance committee and pass a speaking order disposing of the writ petitioner's application. We make it clear that since the writ petition was filed way back in the year 2017, the writ petitioner will not be non-suited on the ground of limitation. His claim will have to be disposed of only on merits and as per law. We further indicate that we have not gone into the merits of the matter. Decision in this regard shall be taken within a period of three months from the date of receipt of the application.
