Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the respondents 2 to 4 to assess the property tax of the petitioner's house property situated at S.No.44/5B bearing Door No.3/234-1, P.Kumaralingapuram Village, Valliyur Village Panchayat, Virudhunagar Panchayat Union, Taluk and District from the assessment year 2019-2020 to 2023-2024 by considering the petitioner's representation dated 15.07.2023.

ORDER

This Writ Petition has been filed to direct the respondents 2 to 4 to assess the property tax of the petitioner's house property situated at S.No. 44/5B bearing Door No.3/234-1, P.Kumaralingapuram Village, Valliyur Village Panchayat, Virudhunagar Panchayat Union, Taluk and District from the assessment year 2019-2020 to 2023-2024 by considering the petitioner's representation dated 15.07.2023.

2. The learned counsel appearing for the petitioner would submit that, on previous occasion, the petitioner has filed a similar Writ Petition in W.P. (MD)No.2924 of 2023 and this Court vide order dated 27.02.2023, observed that the representation of the petitioner dated 31.01.2023 has been disposed by letter dated 25.02.2023. However, in the letter dated 25.02.2023, the fourth respondent without application of mind has passed the order in respect of Natham Patta No.44/5C instead of S.No.44/5B, where the petitioner's house property is situated. Therefore, the petitioner once again made a representation on 15.07.2023 and approached this Court by way of filing this Writ Petition.

3. The learned Special Government Pleader appearing for the respondents would submit that the representation dated 15.07.2023 submitted by the petitioner would be considered by the second respondent within the time stipulated by this Court.

4. I have given due consideration to the submission made on either sides.

Under the facts and circumstances, the second respondent is directed to consider the petitioner's representation dated 15.07.2023, assess the property tax of the petitioner's property situated in S.No.44/5B, Door No. 3/234-1, P.Kumaralingapuram Village, Valliyur Village Panchayat, Virudhunagar Panchayat Union, Taluk and District from the assessment year 2019-2020 to 2023-2024, and pass appropriate orders, within a period of six

(6) weeks from the date of receipt of a copy of this order.
