O R D E R
Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for respondents 1 to 3 and the learned Special Government Pleader appearing for the fourth respondent.
2. Issuance of notice to the private respondents is dispensed with.
3. The writ petitioner is a resident of Godalvavi Village in Dindigul West Taluk. He alleges that in survey No.196, there are encroachments and since the authorities have not taken any action 2/4
3 W.P.(MD)NO.24607 OF 2025 for removing the same, the present writ petition has been filed.
4. When the matter was taken up for hearing, the learned Government Advocate admitted that survey No.196 has been classified as water body.
5. The Tahsildar / third respondent herein is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The entire exercise will be completed within a period of three months from the date of receipt of a copy of this order. The fourth respondent is also directed to extend their fullest cooperation for removing the encroachments. Due opportunity shall be provided to all the encroachers. This writ petition stands disposed of accordingly. No costs.
