ORDER

This Criminal Original Petition is filed to direct the Learned Judicial Magistrate No.3, Thoothukudi to consider the Recall warrant petition filed by the petitioners U/Sec.70(2) of Cr.P.C on the same day of surrender before the Learned Judicial Magistrate No.3, Thoothukudi in connection with the case in Crl.M.P.NO.3073 of 2018 in D.V.C.No.61 of 2017.

2.Learned Government Advocate submitted that the petitioner is facing proceedings in D.V.C.No.61 of 2017 before the trial Court in Crl.M.P.No.3073 of 2018. Eventhough notice was ordered to the petitioner and others, they failed to appear. Therefore, a non bailable warrant was issued.

3. Let the petitioners appear before the concerned trial Court and work out their remedy through appropriate proceedings. 2/4

4. With this direction, this Criminal Original Petition is disposed of.
