This petition is filed under Clause 12 of the letters patent act, to set aside the order dated 24.06.2016 made in WP.(MD). No.10681/2016 and quash the impugned order Lr.No.227/CAI/AU/2016, issued by the 1st respondent in so far as it directs the appellant to produce the structural stability certificate from the 4th respondent for grant of provisional affiliation for the academic year 2016-17. Prayer in CMP(MD). 6331/ 2016 :
This petition is filed to issue an Interim Direction granting the Petitioner provisional affiliation for the academic year 20162017 and include the Petitioners name in the list of affiliated colleges for the year 2016-2017 and allocate the Counselling Code pending disposal of the WA.(MD).No.1043/2016. [Order of the Court was made by R.SUBBIAH, J.] The present Contempt Petition has been filed alleging that the order of this Court dated 30.06.2016 made in W.A.(MD).No.1043 of 2016 and C.M.P.(MD).No.6331 of 2016, has not been complied with.
2. Today, when Contempt Petition is taken up for consideration, it is submitted by the learned Additional Advocate General appearing for the respondent that as against the order dated 30.06.2016 made in W.A.(MD).No.1043 of 2016 and C.M.P.(MD).No.6331 of 2016, S.L.P. (C).Nos.18856-18857 of 2016 were filed by the respondent herein, which were disposed of by the Hon'ble Supreme Court, on 26.08.2016, recording the submission made by the learned counsel for the petitioner college that the petitioner college not wish to contest the petitions for Special Leave to Appeal and the order passed by the High Court may be set aside and that the students may be accommodated in some other nearby college, for which the learned counsel for the petitioners therein stated that they will do the needful within two weeks. Accordingly, the Special Leave Petitions were disposed of, observing that the two years, which the students have spent in the college, [petitioner herein], may be given due recognition in accordance with law.
3. In view of the above, we are of the considered view, nothing survives for consideration in this Contempt Petition. Therefore, the Contempt Petition is closed.
