Respondents PRAYER: Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents 1 to 3 to cancel the ration card given to the sixth respondent in the address, namely, No.64, Thanga Vilas Nagar, Srinagar Colony, Ward 6, Kumbakonam, by the fifth respondent and the residential certificates issued in favour of the sixth respondent and his family members dated 19.12.2016 by the fourth respondent, pursuant to the representation of the petitioner dated 29.07.2017.

ORDER

The petitioner has filed this writ petition for a mandamus to cancel the ration card issued to the sixth respondent in the address, No.64, Thanga Vilas Nagar, Srinagar Colony, Ward 6, Kumbakonam. 2.According to the petitioner, the sixth respondent has encroached his property and managed to get residential certificate and ration card with the help of the fifth respondent / Taluk Supply Officer. 3.Learned Additional Government Pleader, on instructions, submitted that the sixth respondent is not residing in the subject place. 4.Learned Legal Aid Counsel, who was appointed by this Court to represent the sixth respondent, expressed his difficulty in getting instructions.

5.Since it is reported that the sixth respondent is not residing in the subject place and the sixth respondent is not responding to this writ 3/6

petition, this writ petition stands disposed of, with a direction to the fifth respondent / Taluk Supply Officer to conduct an enquiry and to take a decision, after affording due opportunity of hearing, as regards the ration card provided to the sixth respondent. Such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

There shall be no order as to costs.
